§ 42-6. Failure to appear and/or failure to obey a court order.

  • As it pertains to a traffic citation of any type issued in the City of Aliceville, if the person so charged fails to appear as specified in the citation, or, after having initially appeared thereon and receiving any sentence or further orders of the municipal court, such person subsequently fails to obey such sentence or further orders issued by the municipal court, the judge or magistrate having jurisdiction of the offense may issue a warrant for such person's arrest and commanding that such person be arrested and brought before the court to answer the initial charge contained in the citation or answer why said person has failed to obey any sentence or further orders given by the municipal court pursuant to said charges. Upon the arrest of such person against whom a warrant has been issued and served, bond may be posted and given in whatever amount and under whatever terms and conditions are ordinarily imposed or set by the municipal court. further, any such person so arrested on a warrant for the failure to appear or failure to obey a court order who is found to have willfully violated his obligation to appear, or fails to appear after notice given from the court, or is found to have willfully failed to obey any sentence or further orders issued to said person by the municipal court, may be found guilty of the separate offense of failing to appear and/or failing to obey a court order, a further class C misdemeanor, regardless of the disposition of the charge upon which he was originally cited. further still, any such person so arrested on a warrant for the failure to appear or failure to obey a court order who is found to have willfully failed to appear or failed to follow or violated any prior sentence or further order of the municipal court on the underlying traffic citation, may be ordered to pay and be subjected to any and all penalties and punishments applicable to a class C misdemeanor, including, but not limited to, fines, applicable court costs, jail sentence, and forfeiture of any bond posted. Such sanctions may be applicable in conjunction with or independent of any other proceeding, process, or remedy provided by law as the court shall deem appropriate.
